US Online Gambling Regulation โ Overview
Online gambling in the USA is legal in many states โ but regulated state by state, not by a single federal law. If your state has licensed it and you use a licensed operator, you are playing entirely within the law.
Three federal laws shape the landscape. The UIGEA (2006) does not ban gambling โ it restricts payment processors from handling payments for unlawful internet gambling, but explicitly exempts intrastate (within-state) gambling. The Wire Act (1961) was reinterpreted by the DOJ in 2011 to apply only to sports betting, allowing states to license online casinos and poker. And the PASPA repeal (2018) โ Murphy v. NCAA โ struck down the federal ban on sports betting, opening the door for every state to legalise it independently.
Which states have online gambling?
Online casino gaming is fully legal and live in seven states: New Jersey (since 2013), Delaware (2012), Pennsylvania (2019), West Virginia (2019), Michigan (2021), Connecticut (2021) and Rhode Island (2023). Maine authorized online casino and sports wagering in January 2026 โ becoming the 8th state โ but its market has not yet launched (expected late 2026 or early 2027). Nevada allows online poker only. Sports betting is legal in 38+ states and Washington DC, with more legalising every year.
Federal gambling tax โ what players must know
The IRS treats gambling winnings as taxable income. You must report all winnings on your tax return โ there is no minimum threshold. For significant wins, operators are required to withhold 24% automatically and issue a W-2G form. You can deduct gambling losses up to the total of your reported winnings, but only if you itemise deductions. Keep a detailed record of every session โ wins and losses โ to make filing accurate and defensible.
Geolocation enforcement
Licensed US operators use GPS and IP-based geolocation to verify you are physically inside a legal state before you can play. New Jersey โ The Online Gambling Capital
New Jersey was the first state to fully legalise online casino gaming and poker in 2013, following the DOJ's 2011 Wire Act reinterpretation. Pennsylvania passed the Gaming Expansion Act in 2017 and went live in 2019. It is now the largest online gambling market in the US by revenue, driven by its 13 million+ population. Michigan โ Fastest Growing
Michigan launched in January 2021 and quickly became one of the most competitive markets in the US. Connecticut, West Virginia, Delaware & Rhode Island
Connecticut (legal 2021) and West Virginia (2019) both offer full online casino, poker and sports betting. Delaware was the very first state to legalise online gambling in 2012, though its small population (~1 million) limits market size โ three state-partnered operators share the player pool. Nevada โ Poker Only

Sports-Betting-Only States

Federal tax is 37% on large lottery prizes. State taxes range from 0% (in states with no income tax) to over 10%. Jackpot winners can choose a lump sum (roughly 60% of the advertised amount before taxes) or an annuity paid out over 29 years. Most financial advisers note that the after-tax difference between lump sum and annuity depends heavily on your state, investment horizon and personal tax situation.
